Terms and Conditions

Section 1: Introduction

1.1 These terms and conditions (hereinafter referred to as “Agreement”) apply solely to the sale of products by either ELIS TECHNOLOGIES LIMITED (IRELAND) or ELIS TECH S.R.O. (SLOVAKIA) (hereinafter referred to as the “Supplier”). To avoid any doubt your Supplier is the entity specified in the written offer provided to you. The provision of any services by the Supplier is governed by individual contracts entered into between the Supplier and the customer in writing.

1.2 By placing an order for the products, the customer (hereinafter referred to as “Buyer”) agrees to be bound by the terms and conditions of this Agreement.

 

Section 2: Orders and Contract Formation

2.1 All orders for the products are subject to acceptance by the Supplier.

2.2 The formation of a contract between the Supplier and the Buyer will only occur upon acceptance of the Buyer’s order by the Supplier.

 

Section 3: Payment

3.1 Unless otherwise agreed in writing, payment in full must be received by the Supplier before any Products will be dispatched or any services will be commenced.

3.2 The Supplier reserves the right to refuse to supply the products if the Buyer has a history of late or non-payment.

 

Section 4: Delivery

4.1 The Supplier will use commercially reasonable efforts to deliver the products within the estimated delivery time.

4.2 The delivery time provided by the Supplier is an estimate only and the Supplier shall not be liable for any delay in delivery.

 

Section 5: Product Description and Pricing

5.1 The Supplier takes commercially reasonable measures to ensure that all details, descriptions, and prices of the Products appearing a written offer by Supplier to customer are accurate.

5.2 Prices for the Products are subject to change without notice.

 

Section 6: Warranty

6.1 Supplier warrants that the products it sells to the customer will be free from defects in materials or workmanship for a period of 6 months from the date of purchase (the “Warranty Period”).

6.2 This warranty does not cover normal wear and tear, or any damage caused by unauthorized modifications or repairs.

6.3 If during the Warranty Period a defect arises in the product and the customer gives notice of the defect to Supplier in accordance with this warranty, Supplier will, at its option, repair or replace the defective product, or refund the price paid by the customer.

6.4 All repairs or replacements under this warranty must be performed by Supplier. The customer must return the defective product to Supplier, postage prepaid, with proof of purchase.

6.5 The above warranty is exclusive and in lieu of all other warranties, whether express, implied, or statutory, including any liability arising under any warranty of merchantability or fitness for a particular purpose.

6.6. The customer acknowledges that it is their responsibility to carefully read and follow all instructions, warnings and user manual regarding the use, maintenance and repair of the products provided by Supplier. Supplier shall not be held liable for any damages, defects or malfunctions of the products resulting from improper use, maintenance or repair not in accordance with the user manual provided by Supplier.

6.7 In no event shall Supplier be liable for any direct, indirect, special, incidental, or consequential damages, whether arising out of contract, tort, strict liability or otherwise.

 

Section 7: Limitation of Liability

7.1 The Supplier’s liability to the Buyer in connection with any product purchased from the Supplier is strictly limited to the purchase price of that Product.

7.2 The Supplier shall not be liable for any indirect, incidental, or consequential damages.

 

Section 8: Governing Law

8.1 This Agreement shall be governed by and construed in accordance with the laws of Ireland or Slovakia, as determined by the Supplier’s legal seat.

8.2 Any dispute arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Ireland or Slovakia, as determined by the Supplier’s legal seat.

 

Section 9: Website Disclaimer

9.1 Supplier makes every effort to ensure that the information contained on the website www.elis.tech is accurate and up-to-date. However, Supplier makes no representations or warranties as to the accuracy, adequacy, or completeness of the information contained on the website.

9.2 Supplier reserves the right to make changes to the website at any time without prior notice and assumes no responsibility for updating the information contained on the website.

9.3 The customer assumes the risk of relying on any information contained on the website and shall exercise their own independent judgment in determining the accuracy, adequacy, and completeness of the information.

9.4 The customer acknowledges that they should always rely solely on information provided to them in a written offer by Supplier and that such offer supersedes any information contained on the website.

 

Return Policy

We strive to provide our customers with products and services of the highest quality, and we hope that you are completely satisfied with your purchase. However, if for any reason you need to return an item, our return policy is as follows:

  1. Eligibility: All returns must be made within 10 days of receipt of the product, and the product must be in its original condition, sealed, unused and with all original packaging, documentation, stickers and tags intact.
  2. Process: To initiate a return, please contact our customer service team by email at sales@elis.tech to obtain a return authorization number. Returns without a valid return authorization number will not be accepted.
  3. Shipping: The customer is responsible for the cost of shipping the item back to us. We recommend using a traceable shipping method, as we are not responsible for lost or damaged packages.
  4. Refunds: Once we receive the returned item, we will inspect it to ensure it meets the eligibility criteria. If the item is eligible for a return, we will issue a refund to the original payment method within 15 business days.
  5. Exclusions: The following items are not eligible for return: sale items.
